Terms and Conditions of Use

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS RELATING TO YOUR USE OF THIS SITE CAREFULLY. By using this site, you agree to these terms and conditions of use. We reserve the right to modify them at any time, and you should check these terms and conditions periodically for changes. By using this site after we post any changes to these terms and conditions, you agree to accept those changes, whether or not you have reviewed them. If at any time you choose not to accept these terms and conditions of use, please do not use this site.

Parental Permission

The AdRespect site is written for all audiences and is intended especially for business professionals. It deals only with public advertising for all ages, but a very small number of advertisements include nudity or sexual references due to varying regional, national and international tastes. Some parents or guardians may not consider all such content on the site appropriate for their children, and may want to review the archive first. WE STRONGLY RECOMMEND THAT ALL CHILDREN ASK FOR THEIR PARENTS' PERMISSION BEFORE VIEWING THIS SITE.

Privacy Policy

We are committed to protecting your privacy and security. AdRespect's privacy policy applies only to your use of all of the sites and services owned or operated by AdRespect. This policy does not apply to your use of unaffiliated sites to which any of AdRespect's site only links.

We will never intentionally disclose any personal identification information about you as an individual user (such as, for example, your full name, street address, telephone number, credit card number or e-mail address) to any third party without having received your permission. We may request personal identification information from you in connection with AdRespect activities, services or resources we make available on our site or other official activities. In all of these cases, we will collect personal identification information from you only if you voluntarily submit such information to us.

If you do provide us with personal information, we may use it to conduct the activities described above. If you identify yourself to us by sending us an e-mail with questions or comments, we may use your personal information to respond to your questions or comments. We may file your comments for future reference, or we may discard the information after we have reviewed it. By providing us with personal information, you give us your permission to send you e-mails to inform you of changes to our site or other information we think might be of interest to the users of our sites.

The following exceptions to these policies are: We will release specific information about you or your account to comply with any valid legal process such as a search warrant, subpoena, statute or court order. We will also release specific information in special cases, such as if there is an attempted breach of the security of AdRespect's web site, or a physical threat to you or others.

Please note that personal comments you volunteer to us for publication, such as your opinions and sexuality (but NOT contact or billing information such as address, e-mail, telephone, or credit card data), may be collected and re-published by third party search engines. Although we protect our users' private data, we cannot guarantee the security of information you post about yourself, and it is difficult to remove on other sites. You disclose such information at your own risk.

Restrictions on Use of Materials

The contents of this site are protected by copyright and trademark laws, and are the property of AdRespect and various other owners. Unless we say otherwise, you may access the materials located within the AdRespect's site only for your personal use. This means you may download one copy of posted materials on a single computer for personal, noncommercial home use only, so long as you neither change nor delete any author attribution, trademark, legend, copyright or other legal notice. You may not modify, copy, publish, display, transmit, adapt or in any way exploit the content of AdRespect's site. If permission is granted by us and by all other entities with an interest in the relevant intellectual property, you may not change or delete any author attribution, trademark, legend, copyright or other legal notice.

You must abide by all additional copyright or other notices or other restrictions contained in AdRespect's site.

General Submissions

We welcome comments about AdRespect's site and all ads in the archive. All comments, quotations or references, from or about individuals included on this site, are not to be construed as indicative of that person's sexual orientation, conduct or personality.

All comments submitted to the site by visitors are reviewed by editors. Differences of opinion are encouraged, but AdRespect editors reserve the right to occasionally refuse to post comments at their discretion.

Visitors should be certain of their comments and name information provided before submitting them to be published, as AdRespect.org is quickly catalogued by Internet search engines such as Google, making all postings perpetually searchable and changes to material on search engines is difficult. AdRespect accepts no responsibility for indexed page listings on third-party web sites, such as the Google search engine.

Except when submitted according to this agreement, we will not review or consider any unsolicited creative submissions. This policy is intended to avoid the possibility of future misunderstandings in the event that projects developed by our staff might seem to others to be similar to their own creative work. Accordingly, we must ask that you not send us any original creative ideas, suggestions or materials.

If, despite our request, you send us any creative idea, suggestion or material ("Submission"), it shall become our property, though through prearrangement things can also be returned. No Submission, including the identification of the submitter, will be subject to any obligation of confidence by us, and we will not be liable for any use or disclosure of any Submission or identification. We will exclusively own all known or later-existing rights to the Submission worldwide, and will be entitled to the unrestricted use of the Submission for any purpose, without compensation to the provider of the Submission. You may not transmit any information, software or other material that contains a virus or other harmful component.

By submitting a comment to AdRespect, you grant (or warrant that the owner of such rights has expressly granted) AdRespect the worldwide, perpetual, nonexclusive right to use your questions and comments in their original or edited form, on our site, in books, articles, commentaries, videos, or in any other medium now known or later developed. You also warrant that you own or otherwise control all of the rights to the content you have submitted and that the use of such content by AdRespect will not infringe the rights of any third party. Additionally, you warrant that any "moral rights" in submitted materials have been waived. You are not entitled to any compensation for such use.

Submissions of Advertisements

We welcome and appreciate submissions of LGBT-themed advertisements. However, you may not send us any material that is libelous, defamatory, obscene, abusive, invades a person's privacy, violates any intellectual property rights, or that would otherwise violate any law.

By submitting an advertisement, you grant (or warrant that the owner of such rights has expressly granted) AdRespect the worldwide, perpetual, nonexclusive right to reproduce, use, distribute, modify, publish, display, transmit, and adapt the advertisement in its original or edited form, on AdRespect's site, in books, articles, commentaries, videos or in any other medium now known or later developed. You also warrant that you own or otherwise control all of the rights to the content you have submitted and that the public posting and use of such content by AdRespect will not infringe the rights of any third party. Additionally, you warrant that any "moral rights" in posted materials have been waived. You are not entitled to any compensation for such use.

We take great care with submissions provided to us and original material can be returned if it is prearranged with us, but we accept no liability for returned originals if they become lost or damaged. Review of materials offers no guarantee of their use on the web site or in the project.

Submission of Ad Comments and Forum Posts

All ad comments and forum posts from site visitors are considered letters to the editor that may be published. Differing points of view are encouraged, but submissions must always remain respectful in language and tone. Comments should be focused on the topic or advertisement at hand and are not an opportunity to attack or insult other people or previous postings, nor are they for general rants, religious/moral views, or solicitations. The editor reserves rights to refuse publication of any comments, as well as to post them in any order. Modifications to existing posts are not allowed, but exceptions may be considered on a case-by-case basis.

Scope of Terms and Conditions

These terms and conditions apply to your use of all of the sites and services owned or operated by AdRespect Advertising Education Program Corp. ("AdRespect") and any other site that we have owned or operated, do own and operate or may own or operate in the future. These terms and conditions do not apply to your use of unaffiliated sites to which AdRespect only links.

These terms will be governed by and construed in accordance with the laws of the State of New York, without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in the state or federal courts located in New York County, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any of these terms and conditions are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions. This is the entire agreement between you and AdRespect relating to the subject matter it contains. This agreement may be modified only by our posting of changes to these terms and conditions, or by a document signed by both parties.
